DETERMINATION OF NONSIGNIFICANCE (DNS) FOR AMENDMENTS TO PORT ORCHARD MUNICIPAL CODE (POMC) 20.68 ACCESSORY DWELLING UNITS – OWNER OCCUPANCY REQUIREMENTS, AND RESCINDING POMC 20.38.235 MCCORMICK VILLAGE OVERLAY DISTRICT (MVOD)– DETACHED ACCESSORY DWELLING UNITS DESCRIPTION OF PROPOSAL:  The City is considering amendments to the POMC 20.68 Accessory Dwelling Units and rescinding POMC 20.38.235 MVOD detached accessory dwelling units. The purpose of the ordinance is to eliminate an owner occupancy requirement of properties with an accessory dwelling unit. PROPONENT: City of Port Orchard LOCATION OF PROPOSAL:  Citywide LEAD AGENCY:  City of Port Orchard DETERMINATION: The City of Port Orchard, as lead agency for this proposal, after reviewing a completed environmental checklist and other information on file, has determined that the proposed project does not have a probable adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21C.030 (2)(c). Information on file for this proposed project is available to the public on request to the lead agency. This Determination of Non-Significance (DNS) is issued May 20, 2022 under WAC 197-11-340 and Port Orchard Municipal Code (POMC) Title 20. The lead agency will not act on this proposal for 14 days from the date of issue.

Comments must be submitted no later than 4:30 p.m., on June 3, 2022, 14 days from the date of this notice. Appeal: You may appeal this determination to the City of Port Orchard Clerk’s Office at 216 Prospect Street, Port Orchard, WA no later than June 17, 2022 at 4:30 pm in accordance with POMC 20.160.240(6)(b). Appeals shall be submitted in writing, and must include the content required in POMC 20.160.240(10), and applicable appeal fee, as established by resolution of the city council ($450);
