PROJECT: Amendment of Annexation Agreement No. 085-11 PERMIT APPLICATIONS: Agreement (LU22-DEV AGREEMENT-02) LOCATION OF PROPOSAL: The Development Agreement applies to the following tax parcels: 082301-2-002-2004, 082301-2-003-2003, 082301-1-013-2003, 082301-2-004-2101, 082301-1-010-2006, 082301-1-014-2002, 172301-2-002-2003, 172301-2-004-2001, 172301-2-003-2002, 172301-2-006-2009, 172301-2-005-2000, 172301-2-007-2008, and 172301-3-004-2009. DESCRIPTION OF PROPOSAL:  Amendment to the Annexation Agreement for McCormick West entered into on November 22, 2011. McCormick is financing and constructing five projects on the City’s current Capital Improvement Plan that will enable the City to provide water to areas of the City outside of the McCormick Property and McCormick will receive partial reimbursement for this investment in the Five CIP Projects by means of the Water CFC Credit. The term of the Development Agreement is extended through the term of the credit agreement not to exceed 20 years from the date of execution of the Development Agreement. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). The decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public on request. The proposal is a non-project action per WAC 197-11-774. All project-level actions will be subject to individual environmental review at the time of their application. The DNS is issued pursuant to WAC 197-11-340(2)(a)(v); the lead agency will not act on this proposal for 15 days from the date of issue. DATE OF ISSUE: April 18, 2022 COMMENT DEADLINE: May 2, 2022 at 4:30pm APPEAL PERIOD: Pursuant to RCW 43.21C, any person wishing to appeal this determination may file such an appeal within 14 days from the date of issue. You should be prepared to make specific factual objections. There is a fee to appeal this determination.  Appeals must be filed with the City of Port Orchard Clerk’s Office by 4:30pm on May 16, 2022
