NOTICE OF APPLICATION AND NOTICE OF HEARING

This is a public notice regarding a proposed development agreement (LU23-DEV AGREEMENT-05) related to the development of an orthodontic clinic and the preservation of a significant tree at the northeast corner of Mitchell Avenue and Taylor Street in Port Orchard. Please be aware there are deadlines for comments and appeal; if you do not adhere to these deadlines, your comments may not be considered and/or you may lose your right of appeal. The City Council will conduct a public hearing during its regular meeting on October 24, 2023, at 6:30 pm, to discuss the adoption of an ordinance for a Development Agreement related to this project. Any interested person may comment on this application. The public comment period will remain open until 4:00 p.m. on October 24, 2023.  After this time, additional comments will only be accepted during the public hearing held before the City Council on October 24th at 6:30p.m. at Port Orchard City Hall, 216 Prospect Street, Port Orchard, WA 98366 and online via Zoom.  A Zoom meeting link is published on the City Council meeting agenda which is made available on the City’s website at https://portorchardwa.gov/city-council-agendas/.  The City Council agenda for the October 24th City Council meeting containing this zoom link will be posted on October20, 2023. A State Environmental Policy Act (SEPA) Determination of Significance (DS) was issued on August 14, 2020, and a Final Environmental Impact Statement (FEIS) was issued on April 26, 2021, for the Downtown Port Orchard Subarea Plan. The development agreement application qualifies under Planned Action under Ordinance 031-21, and no additional SEPA review is required.
