DETERMINATION OF NON-SIGNIFICANCE (DNS)

PROJECT: City of Port Orchard Marina Pump Lift Station Project

PERMIT APPLICATIONS: Shoreline Substantial Development Permit LU22-SH SDP-02

Location OF PROPOSAL: 721 Sidney Parkway, Port Orchard, WA 98366, APN 262401-1-007-2008

DESCRIPTION OF PROPOSAL: Repairs and improvements to the existing Marina Pump Station facility, associated appurtenances, utilities, and site improvements including grading activities and the removal of impervious surfaces. Repairs and improvements include an above-grade bathroom and entrance to a below-grade pump station with a proposed above-grade multi-use facility housing odor control, electrical equipment, and a diesel-engine driven emergency pump. This proposed facility is intended to prevent sewer overflows into Puget Sound.

DETERMINATION:       The lead agency for this proposal has determined that it does not have a probable significant adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21 C.030(2)(c). The decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public on request.

This Determination of Non-Significance (DNS) is issued October 28, 2022 under WAC 197-11-340 and POMC Title 20. The lead agency will not act on this proposal for 14 days from the date of issue.

Comments must be submitted no later than 4:30 p.m., on November 14, 2022, 14 days from the date of this notice.

APPEAL DEADLINE: November 28, 2022 at 4:30pm

APPEAL PERIOD: Pursuant to RCW 43.21C, any person wishing to appeal this determination may file such an appeal within 14 days from the date of issue. You should be prepared to make specific factual objections. There is a fee to appeal this determination.  Appeals must be filed with the City of Port Orchard Clerk’s Office by 4:30pm on November 28, 2022.
