MITIGATED DETERMINATION OF NONSIGNIFICANCE (MDNS) FOR
THE KFC PORT ORCHARD PROJECT
DESCRIPTION OF PROPOSAL: Site development and construction of a retail building with an accessory drive-through, sidewalks, landscaping, improvement of Vallair connector as described in the adopted Bethel Sedgwick Corridor Plan, and improvements to the existing Vallair Court roadway. Associated improvements for the project site to be constructed include parking areas, vehicle and pedestrian circulation facilities, landscaped areas, refuse enclosure areas, all required wet and dry utilities, stormwater drainage facilities and frontage improvements to adjacent roads. A new driveway will be constructed to provide access to the project site from the Vallair connector. The project site is zoned Commercial Corridor (CC). The size of the project site is approximately 42,253 sf (0.97 acres).

LOCATION OF PROPOSAL: The KFC Port Orchard project site is located on two (2) adjacent parcels addressed as 1570 & 1600 SE Vallair Ct, Port Orchard, WA 98366. The project site is located at the southwest corner of the intersection of Bethel Road SE and SE Vallair Ct in the City of Port Orchard. Tax parcel numbers (APN) 4737-000-002-0000, and 4737-000-001-0001.
LEAD AGENCY: City of Port Orchard
SEPA DETERMINATION: The City of Port Orchard, as lead agency for this proposal, after reviewing a completed environmental checklist and other information on file, has determined that the proposed project may have an adverse impact on the environment and mitigating conditions have been included with this determination to offset these impacts. An environmental impact statement (EIS) is not required under RCW 43.21C.030 (2)(c)), provided the SEPA conditions listed below are used to mitigate potential adverse impacts, Information on file for this proposed project is available to the public on requests to the lead agency.
SEPA CONDITIONS: The SEPA Environmental Checklist and associated appendices and responses to requests for additional information comprise the City of Port Orchard’s record. Pursuant to Port Orchard Municipal Code Title 20, the City relies on the SEPA Environmental Checklist in conditioning project approval.
Impact:
The project will fill approximately 1,170 square feet of an isolated Category IV wetland.
Project Mitigation:
The applicant shall provide enhancement of approximately 6,875 square feet of off-site wetland and approximately 8,301 square feet of off-site wetland buffer enhancement to achieve no net loss of wetland function and value as described in the December 2, 2022, Ecological Land Services Wetland Mitigation Plan. The proposed wetland mitigation site, on APN 4062-002-001-0002, consists of a Category III wetland adjacent to Blackjack Creek within the same watershed as the proposed wetland development site. In the absence of a mitigation bank site, the proponent shall provide Notice to Title consistent with POMC 20.162.030 protecting the mitigation site in perpetuity prior to issuance of the associated Land Disturbing Activity Permit.
This Mitigated Determination of Nonsignificance (MDNS) is issued pursuant to WAC 197-11-350 and POMC Title 20. The City of Port Orchard will not act on this proposal for fourteen (14) days from the issue date below.
Comments must be submitted no later than 4:30 p.m. May 23, 2023 to the City’s Responsible Official.
Appeal: You may appeal this determination to the City of Port Orchard Clerk’s Office at 216 Prospect Street, Port Orchard, WA no later than June 6, 2023 at 4:30pm in accordance with POMC 20.160.240(6)(b). Appeals shall be submitted in writing, and must include the content required in POMC 20.160.240(10), and applicable appeal fee, as established by resolution of the city council; full appeal procedures can be reviewed under POMC 20.160.240.
