MITIGATED DETERMINATION OF NONSIGNIFICANCE (MDNS) FOR THE TURTLE RIDGE PRELIMINARY PLAT

DESCRIPTION OF PROPOSAL: The project proposes the development of 10 single family residential lots and 4 tracts on a single 8.84-acre parcel. This subdivision will be accessed from Caseco Lane, which is a private road. All lots will access from one internal private road that terminates in a cul-de-sac. General improvements will include water service, sanitary sewer service, a storm drainage collection and conveyance system, and other utilities such as telephone, and power, as well as improvements to Caseco Lane. Water and sewer will be provided by the City of Port Orchard. PROPONENT: John Knowles & Associates, Inc. PO Box 1328, Puyallup, WA 98371. LOCATION OF PROPOSAL: SEC 27, TWP 24N, RNG 1E (SE/4). Nearest Intersection is Caseco Ln & Wilkins Dr. Tax parcel #272401-4-064-2001.

LEAD AGENCY: City of Port Orchard. SEPA DETERMINATION: The City of Port Orchard, as lead agency for this proposal, after reviewing a completed environmental checklist and other information on file, has determined that the proposed project may have an adverse impact on the environment and mitigating conditions have been included with this determination to offset these impacts. An environmental impact statement (EIS) is not required under RCW 43.21C.030 (2)(c)), provided the SEPA conditions listed below are used to mitigate potential adverse impacts, Information on file for this proposed project is available to the public on requests to the lead agency. SEPA CONDITIONS: The SEPA Environmental Checklist and associated appendices and responses to requests for additional information comprise the City of Port Orchard’s record. Pursuant to Port Orchard Municipal Code Title 20, the City relies on the SEPA Environmental Checklist in conditioning project approval. Impact: Increased demand by approximately 50% on the existing substandard private road, Caseco Lane, which serves the development, including additional impacts of construction equipment during build out of the plat. Project Mitigation:

  1. Prior to final plat, the applicant shall complete road improvements to Caseco Lane along the property frontage and on Caseco Lane connecting to Wilkins Drive/Bay Street. The improvements shall meet the city’s Public Works Engineering Standards and Specifications (PWESS) or a lesser standard to be approved through a deviation request. A deviation request was submitted with the preliminary plat application materials, however, requests for deviations from the PWESS are reviewed and approved through the Land Disturbing Activity Permit process. If granted, this proposed deviation will be considered adequate to meet the requirements of this condition. 2. Prior to final plat, the applicant shall repair damage to Caseco Lane caused during construction to the satisfaction of the City of Port Orchard.  The existing road along the property frontage and connecting to Bay Street shall be patched and crack sealed to the satisfaction of the City Engineer. This Mitigated Determination of Nonsignificance (MDNS) is issued pursuant to WAC 197-11-350 and POMC Title 20. The City of Port Orchard will not act on this proposal for fourteen (14) days from the date of issuance. Comments must be submitted no later than 4:30 p.m. June 20, 2023 to the City’s Responsible Official. Appeal: You may appeal this determination to the City of Port Orchard Clerk’s Office at 216 Prospect Street, Port Orchard, WA no later than July 5, 2023 at 4:30pm in accordance with POMC 20.160.240(6)(b). Appeals shall be submitted in writing, and must include the content required in POMC 20.160.240(10), and applicable appeal fee, as established by resolution of the city council; full appeal procedures can be reviewed under POMC 20.160.240.
