STATE ENVIRONMENTAL POLICY ACT MODIFIED DETERMINATION OF NON-SIGNIFICANCE (DNS)           Date of Issuance: October 29th, 2025 PROJECT: 1061/1083 HULL AVE REZONE PERMIT APPLICATIONS: Site-Specific Rezone LU25-REZONE-01 LOCATION OF PROPOSAL: 1061/1083 Hull Ave, Port Orchard, WA 98366 APNs #352401-2-015-2005 and 352401-2-018-2002. DESCRIPTION OF PROPOSAL: Application for a site-specific rezone from Residential 2 (R2) to Residential 3 (R3). APPLICANT: Noel Larsen, 1909 Holdings, LLC 2612 Burwell St 98312 LEAD AGENCY: City of Port Orchard SEPA OFFICIAL: Nicholas Bond, Department of Community Development Director 216 Prospect Street Port Orchard, WA 98366 (360) 874-5533 SEPA DETERMINATION: The City of Port Orchard, as lead agency for this proposal, has modified the DNS issued on September 18th, 2025 in consideration of the following changes: Insufficient open public comment period of twelve (12) days. Per WAC 197-11-340, WAC 197-11-680, and POMC Title 20, comments to the lead agency shall be within fourteen (14) days of date of issuance of the DNS. The lead agency has determined that it does not have a probable significant adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21 C.030(2)(c). The decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public on request. The DNS process is issued pursuant of WAC 197-11-340, WAC 197-11-680, and POMC Title 20. Comments are due by November 12, 2025 at 4:00pm. A fourteen (14) day appeal period will follow the fourteen (14) day comment period. APPEAL PERIOD: Any person may appeal this determination to the City of Port Orchard Clerk’s Office at 216 Prospect Street, Port Orchard, WA no later than November 26th, 2025 at 4:00pm in accordance with POMC 20.160.240(6)(b). Appeals shall be submitted in writing, and must include the content required in POMC 20.160.240(10), and applicable appeal fee, as established by resolution of the city council; full appeal procedures can be reviewed under POMC 20.160.240.
