DETERMINATION OF NONSIGNIFICANCE (DNS)
FOR ADOPTION OF AN ORDINANCE AMENDING PORT ORCHARD MUNICIPAL CODE
SECTIONS 20.02,20.12, 20.22, 20.32, 20.34, 20.38, 20.39, 20.68, 20.80, 20.82, 20.98, 20.100, 20.122, 20.124, 20.127, 20.139, AND 20.160, AND THE ADDITION OF SECTION 20.87 RELATED TO ESSHB 1110, ESSB 2321, EHB 1337 AND SB 5184 IN IMPLEMENTATION OF THE CITY OF PORT ORCHARD 2024 COMPREHENSIVE PLAN.
DESCRIPTION OF PROPOSAL: The City of Port Orchard is considering an amendment to Port Orchard Municipal Code 20.02, 20.12, 20.22, 20.32, 20.34, 20.38, 20.39, 20.68, 20.80, 20.82, 20.98, 20.100, 20.122, 20.124, 20.127, 20.139, and 20.160, and the adoption of a new section addressing Unit Lot Subdivision POMC 20.87, to satisfy the requirements of ESSHB 1110, ESSB 2321, EHB 1337 and SB 5184 in implementation of the City of Port Orchard 2024 Comprehensive Plan.

LEAD AGENCY: City of Port Orchard
DETERMINATION: The City of Port Orchard, as lead agency for this proposal, after reviewing a completed environmental checklist and other information on file, has determined that the proposed project does not have a probable adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21C.030 (2)(c). Information on file for this proposed project is available to the public on request to the lead agency.
This Determination of Non-Significance (DNS) is issued April 29, 2025, under WAC 197-11-340 and Port Orchard Municipal Code (POMC) Title 20. The lead agency will not act on this proposal for 14 days from the date of issue.
Comments must be submitted no later than 4:30 p.m., on May 13, 2025, 14 days from the date of this notice.
Appeal: You may appeal this determination to the City of Port Orchard Clerk’s Office at 216 Prospect Street, Port Orchard, WA no later than May 27, 2025, at 4:30 pm in accordance with POMC 20.160.240(6)(b). Appeals shall be submitted in writing, and must include the content required in POMC 20.160.240(10), and applicable appeal fee, as established by resolution of the city council;
