SEPA (DNS) – POMC 20.70 Cell Tower Ordinance

DESCRIPTION OF PROPOSAL: The City is considering amendments to the Port Orchard Municipal Code to adopt chapters POMC 20.70 Wireless Communication Facilities and POMC 20.72 Small Cell Wireless Communication Facilities. The purpose of the ordinance is to regulate the placement, construction, and modification of wireless communication facilities and small cell wireless telecommunication facilities, in order to protect the health, safety and welfare of the public, while not unreasonably interfering with the development of the competitive wireless telecommunications marketplace in Port Orchard.  The proposed chapters include standards for the design and aesthetics associated with these facilities. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). The decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public on request. The proposal is a non-project action per WAC 197-11-774; however, all project-level actions will be subject to individual environmental review at the time of their application. The DNS is issued pursuant to WAC 197-11-340(2)(a)(v); the lead agency will not act on this proposal for 15 days from the date of issue.
